Guest Data Transfer Agreement

This Guest Data Transfer Agreement forms part of the Terms of Service and sets out how QRush.delivery provides hotels with the data of guests using the guest app, and how hotels handle it.
Summary: QRush.delivery is the controller of guest data in the app. The hotel receives the data of its own guests to fulfil their orders and is responsible for it as an independent controller.
1. Parties
Transferring party: Sole Proprietor Andrey Anatolyevich Kulachenko, TIN 770765074793, OGRNIP 309774608600785, registered address: 6 Pokrovskaya St., Khotkovo, Moscow Region, 141370, Russian Federation (“QRush”). QRush is registered in the Roskomnadzor register of personal data operators, No. 77-26-574250.
Receiving party: the hotel or other accommodation provider using QRush.delivery (“Customer”).
2. Purpose and basis
QRush provides the Customer with a guest’s data so the Customer can fulfil the orders and requests the guest sent through the app and provide accommodation services. The legal basis is performance of a contract to which the guest is a party.
3. Data provided
- guest name, email address and phone number, if the guest provided them;
- profile photo, if uploaded (only so staff can recognise the guest, not for identification);
- room number, stay dates and delivery point;
- guest orders and requests, comments, ratings and tips.
The guest’s password and device technical data are not provided to the Customer.
4. Customer obligations
- use the data only to serve guests and fulfil their orders;
- keep the data confidential and not disclose or distribute it without the guest’s consent, unless required by law;
- give account access only to authorized staff and remove access for departed staff immediately;
- protect the data, including keeping account passwords secret;
- not export guest data from the Service for marketing without the guest’s separate consent;
- notify QRush at privacy@qrush.delivery of any leak or unauthorized access to guest data within 24 hours of becoming aware of it;
- delete guest data kept outside the Service once it is no longer needed and not required by law.
5. QRush obligations
- provide the Customer only with data of guests staying with the Customer, and only within section 3;
- store the data on a server in the Russian Federation and protect it with appropriate measures;
- handle guests’ requests about their personal data;
- inform the Customer of incidents affecting its guests’ data.
6. Termination
When the Customer stops using the Service, it loses access to guest data in the Service. QRush keeps and destroys guest data under the Privacy Policy.
