Terms of Service Public Offer

These Terms apply to hotels and hospitality businesses (“Customer”) using QRush.delivery (“Service”). By registering an account, using the Service, or making any payment, the Customer accepts these Terms in full.

1. Service

QRush.delivery provides a software-as-a-service (SaaS) website builder and digital ordering platform for hotels and hospitality businesses. The Service provides access to software functionality and digital tools only.

The Service is provided by Sole Proprietor Andrey Anatolyevich Kulachenko, registered in the Russian Federation (registration numbers 770765074793 / 309774608600785).

QRush.delivery does not sell food, beverages, accommodation, or any other hotel services to guests. QRush.delivery does not act as a marketplace, payment agent, or intermediary in transactions between the Customer and its guests.

2. Acceptance of Terms

These Terms constitute a public offer (public contract). The Customer accepts (concludes) this agreement by any of the following actions:

  • registering an account or creating a hotel page on QRush.delivery;
  • using any functionality of the Service;
  • paying any invoice or subscription fee related to the Service.

3. Roles & Data Responsibility

The Customer is the Data Controller for guest personal data. QRush.delivery acts as a Data Processor and processes guest data only on the Customer’s documented instructions, as further described in the Data Processing Agreement.

4. Customer Responsibilities

  • Provide accurate hotel information, menus, pricing, availability, and service descriptions.
  • Ensure lawful processing of guest personal data and provide required privacy notices to guests.
  • Obtain consents where required (including for marketing, if used by the Customer).
  • Comply with all local laws applicable to hotel operations (including alcohol/age restrictions where applicable).
  • Maintain the confidentiality of account credentials and restrict access to authorized staff only.

5. Guest Orders & Payments

The Service may allow guests to submit requests or orders (e.g., room service requests, menu items, drinks, or services) to the Customer. The Customer remains solely responsible for fulfilling such requests and for any goods or services provided to guests.

QRush.delivery does not collect, process, or handle payments made by hotel guests for food, beverages, or services. Any guest payments must be processed directly by the Customer using the Customer’s own payment methods.

QRush.delivery is not a party to transactions between the Customer and its guests and bears no responsibility for the Customer’s performance, pricing, refunds, chargebacks, or disputes with guests.

6. Fees

The Customer pays fees solely for access to and use of the Service functionality (SaaS / IT services), according to the selected plan or invoice. Fees are not payment for guest goods or services.

If the pricing includes usage-based components, such metrics relate to software usage (for example, number of locations, features enabled, or similar technical parameters) as described in the plan or invoice.

7. Payments and Currency

Payments for the Service may be made by Customers located outside the Russian Federation. Payments may be processed via acquiring providers and international payment systems, including bank cards, as available.

All payments under these Terms are made exclusively for software access and IT services provided by QRush.delivery. The Customer is responsible for any bank fees, conversion fees, taxes, or duties applicable in the Customer’s jurisdiction.

8. Limitation of Liability

QRush.delivery is not responsible for hotel content, hotel services, guest interactions, or unlawful actions by the Customer. To the maximum extent permitted by law, QRush.delivery’s total liability is limited to amounts paid by the Customer for the Service during the last three (3) months.

In no event shall QRush.delivery be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, goodwill, or business interruption.

9. Termination

The Customer may stop using the Service at any time. QRush.delivery may suspend or disable access in case of non-payment, breach of these Terms, or to comply with legal requirements.

Upon termination, access may be disabled. The Customer remains responsible for guest data, legal compliance, and any obligations to its guests.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Russian Federation.
